The draft Emergency Ordinance elaborated by the Ministry of Economy in April amending the Romanian Support Scheme for renewable energy, provides for a deferral of payment, for the period July 1, 2013 – December 31, 2016 for part of the green certificates issued to investors in micro hydro-electric, wind and photovoltaic projects, in order to control the increase of electricity prices.

The ‘Eversheds Board Report: The Effective Board’ is a global study that analysed the share price performance of over 500 top companies in Europe, the US, Asia-Pacific, the Middle East and Brazil between 2011 and 2012 to investigate the characteristics of global boardrooms. The report also reflects in-depth interviews with 85 senior board members from around the world. It follows the first Eversheds Board Report published in 2011, the first study to compare board composition and share price performance with research going back to 2007.

No power plant is an island: connecting to the grid

How to exit prejudicial contracts

Honoring the agreement with commercial partners, regardless of the form of this agreement, is one of the rules that any functional economy is based on. This rule is translated into juridical terms by the mandatory force of the contract – once a part of the contract agreed to it, has not only a moral obligation to fulfil the assumed obligations, but also a juridical one.

Although this principle is, without any doubt, one of the fundaments of a healthy commercial environment, there are also exceptional situations when the rigid execution of a contract can affect the commercial relations and justify amendments to it. We are referring here to one of the circumstances in which one of the parts enters the contract in good will but later, for reasons that are not attributable to them, reaches the conclusion that the execution of the contract would be prejudicial for its activities.

The controversial list of health claims allowed on food products

EC Regulation no. 432/2012 establishing a list of generally permitted health claims on food is in effect since December 14, 2012. From this date on, all unauthorized health claims are forbidden from use and products containing such unauthorized terms should be withdrawn from the European market.

Sorin Bonciu, local investor in green energy, takes over the French supermarket chain Interex in Romania. Eversheds Lina & Guia stands by the seller

The transaction through which two local firms are taking over the commercial spaces owned in Romania by the group ITM Enterprises SAS, received the approval of the Competition Council. The buyer is Sorin Bonciu, local investor in renewable energy, who will acquire the supermarkets of CDER Interex SA and European retail Company ERC RO SRL in Romania through the local firms Bomax Invest SRL and Electricom Solar SRL.

Eversheds Lina & Guia next to Italo-Romena in the acquisition of Nova Building

The Italian bank Veneto Banca acquired the office building "Nova Building" in Bucharest, through its Romanian branch Italo - Romena. The Italians bought the offices on Barbu Vacarescu which they previously rented, from the Lebanese founders of Primola chocolate brand. The transaction was closed in December for the price of 17 million Euros.
