Alec S. Bennett

Principal Associate

Alec is a pensions lawyer with extensive experience in advising on public sector pensions law.

He is a Principal Associate in our Employment, Labor and Pensions practice group.

Alec advises both public and private sector clients on a range of employment and pensions law issues. He has particular experience in providing legal advice on employment and pensions issues associated with employee transfers and TUPE (including outsourcing, partnering, joint ventures, public sector companies and mutuals).

Alec provides day-to-day advice to clients covering advice on benefits and administration, the Best Value Direction, New Fair Deal guidance, drafting documentation (including admission agreements, bonds, guarantees, transfer agreements, exit liability agreements), pensions assistance on procurement processes, broadly comparable pension scheme issues, bulk transfer arrangements, large-scale employee transfers and shared service arrangements.

He is also a member of the ELPG Tech Group and has been instrumental in developing the firm's new online document portal, LGPS Create. This system provides a new and innovative way for LGPS Pension Funds to instruct the firm in relation to admission and other related documentation and also provides a quick, efficient and cost-effective solution for the production of documentation using the benefits of automation.  

Alec regularly provides advice to Central Government Departments and other public sector bodies on pensions. An example of this was advising a Central Government Department in connection with transfers of active members from the pension scheme of a nonprofit making government-owned organization to the Civil Service Pension Scheme. Subsequently, he has recently been involved in advising on a second transfer of the remaining active, deferred and pensioner members from the pension scheme to the Civil Service Pension Scheme. Alec has also recently provided advice and assistance to another government-owned company in connection with issues relating to compliance with its auto-enrollment duties. 

He acts on behalf of a number of LGPS Pensions Funds across the country, providing day-to-day advice and assistance (including IDRP and Pensions Ombudsman complaints) and deals with documentation on behalf of the funds, including Admission Agreements, Bonds/Indemnities, Guarantees, Deficit Repayment Agreements, Novation Agreements, Deeds of Confirmation (on amalgamations and transfers of engagements) and Transfer Agreements (on College and Academy Trust mergers).   

Alec also regularly acts for organizations in the Education sector, including universities, colleges and academies, in connection with the Universities Superannuation Scheme, Teachers’ Pension Scheme and Local Government Pension Scheme.       

He also advises trustees and sponsoring employers operating in the private sector in connection with their defined benefit pensions arrangements. This has included providing advice and assistance on matters such as the closure of schemes to future accrual, the establishment of corporate trustees, and day-to-day advice in connection with IDRP process complaints and pensions sharing on divorce. He has also advised a number of private sector contractors in connection with the pensions issues on public sector outsourcing arrangements, including negotiating and agreeing relevant contractual documentation to achieve the desired pension cost risk profile.

Alec also regularly speaks at events on public sector pensions issues and delivers the legal framework session on the LGPC Fundamentals course. 

He also helps to organize and speaks at our popular Public Sector Pensions Conference and Pensions Education Sector Conference each year.  

Alec was previously recognized as an “associate to watch” in connection with his employment work in the legal directories.
