Claire Carroll

Claire is an experienced pensions litigator and regulatory investigations lawyer.

She helps guide clients through complex issues of law and strategy to reach a resolution. Claire is a Partner in the Litigation and Dispute Management team in our London office. She is experienced in complex commercial claims, particularly those relating to financial services or pensions.
 
Claire heads our pensions disputes team and specializes in dealing with a wide range of pensions disputes, including professional negligence claims on behalf of both trustees and employers, representative proceedings seeking directions from the Court, and Pensions Ombudsman complaints. Claire also specializes in dealing with enforcement proceedings instigated by the Financial Conduct Authority. She has conducted many individual accountability reviews, handled whistleblowing investigations and acted as a skilled person on s166 skilled person review. 

Claire regularly provides training for clients, and has spoken at external conferences for a number of industry bodies, including the Association of Pension Lawyers.

She contributes articles and comments regularly, and has contributed several technical notes for Practical Law Company in relation to pensions issues, including "Costs in Pensions Litigation" and "Investment Issues in DC Schemes."

Claire is in the Legal 500 Hall of Fame for Pensions Disputes, and is a Band One individual in Chambers UK, which says: "She is an expert in her field and provides thorough advice."

Claire's experience includes:

  • acted for the Airways Pension Scheme Trustee Limited in the proceedings with British Airways, which settled before reaching the Supreme Court
  • advised Barnardo's in the Supreme Court hearing in June 2018 relating to the ability to change the pension scheme's measure of indexation from RPI to CPI
  • acted for Options Pensions (previously Carey Pensions) in the Court of Appeal dealing with issues surrounding the duty of care owed by an SIPP administrator to members
  • acted on behalf of one of the representative beneficiaries in the Court of Appeal case Trustee Solutions Limited v Dubery and another [2008] 1 All ER 826
     
  • advised the Port of Tyne Authority in the proceedings brought by the trustee of the Pilots National Pension Fund (PNPF Trust Company Ltd v Taylor and others [2010] EWHC 1573 (Ch))
  • acted for the representative members in Entrust Pensions Limited v Prospect House Ltd.
  • advised the representative beneficiary in Trustees of Singer & Friedlander v Corbett (2014), which was the first case to consider whether s75 debts could be assigned
  • Ranked in Chambers UK 2022 as a Band One
