David Flack

Partner

David is a Partner in the Financial Services Disputes and Investigations group in our London office.

He speciaizes in banking litigation, advising on all aspects of banking disputes, as well as on internal/regulatory investigations with a particular focus on wholesale financial institutions. Before joining the firm in April 2014, David was for eight years in-house litigation counsel at UBS AG in London where he was responsible for managing litigation and regulatory investigations for the investment bank in EMEA. 

He has written articles on disclosure and the financial list for Journal of International Banking & Finance Law. He co-leads the Eversheds Sutherland Overseas Banks Legal and Compliance forum and heads up the FSDI Court Orders and Injunctions team. 

David has been individually recognized in 2015’s The Legal 500 for Banking Litigation, where he is described as “very effective.”

David’s recent experience includes:

  • defending a financial institution in relation to possible claims arising from fallout from a large-scale internal Ponzi scheme
  • leading a significant internal investigation into unauthorized trading at an investment bank
  • investigating and advising in relation to mis-selling of investment products to a bank’s international wealth customers
  • conducting a sensitive internal investigation into possible misconduct of a control function within a high-profile financial institution and related whistleblowing allegations
  • advising on high-value costs litigation for a Canadian Energy company in relation to a dispute with the client’s former legal advisers
  • Ranked in Chambers UK 2019
