Catherine is a Principal Associate on the EHS (Environment, Health and Safety) team in Manchester.

Catherine supports multi-national and domestic clients on a full range of non-contentious environmental issues, including strategy regarding dealing with the Environment Agency, providing input into property and corporate transactions, due diligence exercises, and stand-alone environmental issues such as chemical compliance issues, waste, water issues and environmental permitting. She specializes in non-contentious environmental and health and safety matters.

Catherine has extensive experience supporting clients dealing with highly complex and specialized environmental issues. Chemicals-related work is a particular specialism, including in respect of EU/UK REACH (the Registration, Evaluation, Authorisation and Restriction of Chemicals Regulation), EU/UK CLP (Classification, Labelling and Packaging of Chemicals) and the EU/UK BPR (Biocidal Products Regulation). She routinely advises clients on new and developing areas of legislation, addressing issues identified from internal audits, responding to regulatory audits, dealing with customers and suppliers and potential disputes (including data sharing disputes).

She also advises on environmental permitting, waste, contaminated land, emissions and water-related issues. Catherine regularly provides EHS input into corporate and property transactions and due diligence exercises, including advising and providing drafting to allocate environmental liability. She routinely works with environmental consultants and manages multi-jurisdictional compliance projects.

Catherine regularly speaks at conferences and provides training on EHS issues.

Catherine's experience includes: 

  • advising clients in respect of EU/GB REACH and EU/GB BPR obligations and strategy for dealing with customers, including where obligations may not have been complied with
  • supporting a client during REACH audits in various EU jurisdictions, including taking a leading role in reviewing extensive data and producing the templates, slides and summary presented to the relevant regulator
  • advising on product-related obligations including requirements for Packaging Waste, Waste Electrical and Electronic Equipment (WEEE), the Restriction on Certain Hazardous Substances in Electronic Equipment (ROHS) and Batteries including in the context of corporate transactions
  • advising on the legal definition of waste and assessing (from a legal perspective) whether waste should be classified as hazardous/non-hazardous and the differing requirements
  • advising on transfrontier shipment of waste requirements, including those in force post-Brexit
  • advising on steps to mitigate a breach of these requirements, including repatriation of the waste concerned
  • advising on the requirements of the EPC Regulations 2012 (Energy Performance Certificates) and the MEES Regulations 2015 (Minimum Energy Efficiency Standards) and the latest government proposals
  • advising on the Contaminated Land Regime and providing appropriate drafting to reflect the agreed position concerning the allocation of environmental liabilities in sale contracts and leases
  • advising on Natural England's licensing policies regarding European Protected Species and relevant contractual documentation (including NERC Agreements)
  • advising a chemicals manufacturer on a strategy to minimize their penalty in respect of a failure to report and surrender sufficient EU ETS allowances
  • leading a multi-jurisdictional permit review advising on change of control requirements, change of name requirements and the implications of the transfer of relevant entities being by asset transfer rather than a share sale
  • advising buyers and sellers in corporate transactions on environmental issues, including inputting into the negotiation and drafting of environmental indemnities and warranties
