Tom is a Principal Associate in our Manchester office.
He helps financial services firms deal with external disputes and internal issues in a timely and commercial way.
Civil litigation and ADR: Tom handles and resolves complex, high-value and strategically important civil disputes for clients, including bringing recovery actions against commercial debtors and defending claims for breach of contract, breach of statutory duty, negligence, undue influence, economic duress, product mis-selling through misrepresentation, and unfair relationships.
Regulatory disputes: Tom acts for clients responding to quasi-contentious communications from FCA Supervision and investigations led by FCA Enforcement into alleged misconduct, including systems and controls violations, market abuse, mis-selling, and other breaches of regulation and guidance. He is familiar with all stages of the FCA Enforcement process.
Internal investigations: Tom carries out internal investigations for clients and advises on strategic regulatory risk management issues. For example, past business reviews, remediation activity, thematic reviews and s.166 skilled person reviews.
Tom's litigation practice has resulted in the following published judgments:
- a successful restitution claim to recover sums paid to an invoice discounter on the grounds that the discounter had failed to exercise a contractual discretion when setting a percentage rate for charges payable under the discounting agreement (BHL v Leumi ABL Limited [2017] EWHC 1871 (QB))
- a successful summary judgment application to dismiss a multimillion-pound breach of contract claim brought against a bank by a prospective asset purchaser (Astra Asset Management UK Limited v The Co-operative Bank Plc [2019] EWHC 897 (Comm))
