Simone Barnaba is a partner in Eversheds Sutherland’s Italian Litigation Department.

Simone has over 20 years of experience representing multinationals and other major clients in complex civil and commercial litigation, at the trial and appellate levels, including bankruptcy, contract, corporate, unfair competition and other business torts litigation.

In addition to his litigation practice, Simone advises clients on a wide variety of bankruptcy and insolvency matters.

He has represented clients in diverse industries, including oil and gas, pharmaceutical and life science, and financial services.

 

Simone’s recent client experience includes:

- representing a multinational oil company, as a Defendant, in an action brought by the extraordinary administration of an airline seeking the return of a price component paid for the supply of jet fuel at several Italian airports, for several million euros, allegedly charged in violation of antitrust law and certain regulatory provisions

- representing the Italian and Dutch subsidiaries of an oil & gas multinational in two claw back actions brought by the extraordinary administration of an airline seeking the repayment under Italian Bankruptcy Law of certain amounts paid by the airline for jet fuel supplies made at several Italian and European airports before the airline was put in administration

- representing a UK company, as the main Shareholder of an Italian aerospace and defense company, in a proceedings brought by the Italian company’s Directors and minority Shareholders in relation to the Italian company’s composition with creditors proceedings

- representing a leading UK financial services provider in a case brought against it before the Italian Supreme Court of Cassation by the Italian Tax Authority in connection with the tax treatment of the dividends from Italian listed companies under the UK / Italy Convention for the Avoidance of Double Taxation of Income

- representing a global specialty diagnostic company in a case brought by it before the Italian Supreme Court of Cassation against a decision rendered by the Tax Court of Appeals on the tax treatment of the acquisition by the client of the entire share capital of an Italian company

- representing a major Italian bank in a litigation before the Italian Supreme Court of Cassation in an action brought by the bankruptcy of an Italian company claiming over ten million euros damages from the bank

- recently represented a multinational oil company in connection with the garnishment for several million euro of its bank accounts made by two third parties under two judgements issued in proceedings to which the client was not a party, but enforced against our client as the alleged transferee of a business as a going concern

- representing a leading Italian construction company in a multi-party litigation in connection with the construction of a major infrastructure in the south of Italy

- representing a multinational oil company, as a Defendant, in an action brought by an Italian oil company seeking several million euro in damages for alleged breach of contract, unfair competition and other business tort theories

- representing a multinational entertainment company in a litigation brought by a distributor seeking the payment of damages following the termination of a distribution agreement

- representing a multinational oil company in a litigation brought by an advertising company seeking the payment of an additional consideration in connection with certain advertising campaign launched by the client
