Brexit negotiations move to future relationship

The European Council’s endorsement of both the terms of a 21-month transitional arrangement and the guidelines for the third phase of the Brexit negotiations is very positive news for businesses.  This means that discussions can finally commence on the UK’s future relationship with the EU.  The framework for this relationship will be included in a political declaration accompanying and referred to in the Withdrawal Agreement. 

There are still some outstanding separation issues which need to be agreed, the main ones being a solution to avoid a hard border between Northern Ireland and the Republic of Ireland, and the potential ongoing jurisdiction of the Court of Justice of the EU in the UK after 29 March 2018.  The EU has repeatedly stated that the terms of the Withdrawal Agreement will need to be finalised by October 2018 in order to obtain all of the relevant approvals before the UK leaves the EU on 29 March 2018.
