In this month’s article we look at the key principles and issues arising out of termination of EPC contracts under English law. With market conditions testing in the oil/gas industry (as they will be from time to time in other industries) once sound investment decisions may be questioned with Purchasers needing to decide whether to proceed with expensive construction projects or cut their losses. We have identified 10 key issues that are relevant to both Purchasers and Contractors if termination becomes a realistic consideration. We look at the procedures, requirements and consequences of termination by reference to FIDIC Silver Book. Because termination is such a significant step, all parties need to consider their position very careful and ideally with legal advice, before deciding it is the best course to adopt.
