Creation of an international division at the Paris Court of Appeal

On 7 February 2018, the Paris Court of Appeal announced the creation of an international division specialized in international commercial and financial disputes.

After the inauguration of an international division at the Paris Commercial Court in 2010, the creation of an international division at the Paris Court of Appeal sets a clear goal to reinforce the leading position of Paris in the international dispute resolution sphere.

The international division will be staffed with English speaking judges who have experience in dealing with complex international commercial and financial disputes.

With regards to the conduct of the proceedings, a compromise has been found between French constitutional legal requirements, regarding in particular the use of the French language, and the needs of foreign parties.

  • Parties will be able to submit exhibits in English without a translation in French.
  • During the hearing, the parties’ representatives and lawyers, fact witnesses or technical experts will be able to address the Court in English with a simultaneous translation in French.
  • Judges will speak in French, with a simultaneous translation in the language requested by the parties.
  • The Judgments will be rendered in French with a certified translation in English.

The creation of this new international division will allow the parties who negotiate a jurisdiction clause to agree to the jurisdiction of the Paris Commercial Court with the certainty that both at first instance and on appeal, specialized and experienced judges will hear their cases, in English or in any other language since the parties can also resort to interpreters. In addition to the recognised quality cost ratio of the French court system, international parties will accordingly be afforded a further incentive to select the Commercial Court of Paris as the forum for the resolution of their disputes involving a French party.

The international division will start its activities at the beginning of March 2018.
