This briefing summarizes the general government measures recently introduced to mitigate the economic consequences of the COVID-19 pandemic in Hungary. 

New restrictive measures have been introduced during the state of emergency in Hungary:

  • Announced as of 4 November 2020
  • The state of emergency will be constantly reviewed by the Government
  • During the state of emergency, the Government may suspend the application of certain laws or derogate from the provisions of laws

Restrictive measures during the state of emergency in Hungary - The rules of entry 

Rules on the entry of Hungarian citizens in passenger traffic:

  • may undergo a medical examination and must be tolerated
  • in case of suspicion of infection is placed in home quarantine
  • if there is no suspicion of infection it is mandatory to be placed in home quarantine for 10 days from the date of entry
  • in case of negative test results performed twice within five days, at least 48 hours apart, an exemption may be granted

Rules on the entry of foreign citizens in passenger traffic:

  • generally, a non-Hungarian citizen may not enter Hungary

Exceptions for example:

  • participation in court or official proceedings
  • access to health care
  • travel in passenger traffic related to work connected with transport activity
  • for these justifiable reasons, the competent police authority may grant entry to the country at the request of the foreign citizen
  • may undergo a medical examination and must be tolerated
  • in case of suspicion of infection, it is prohibited to enter Hungary
  • if there is no suspicion of infection it will be mandatory to quarantine as designated by the competent epidemiological authority for 10 days from entry
  • in case of negative test results performed twice within five days, at least 48 hours apart, an exemption may be granted

Restrictive measures during the state of emergency in Hungary - Exceptions from the general rules of entry ban

1. Rules on trips between affiliated companies:

  • persons arriving from abroad may enter Hungary without restriction if they are the senior managers or employees of a Hungarian company or a company registered in another state which is the affiliated company of another business entity registered abroad
  • the person intending to enter is obliged to prove that he is traveling on business

2. Provisions for business travel:

  • a Hungarian citizen may return home from abroad without restrictions if the reason for the trip from Hungary was a business activity:
  • it must be credibly proven upon return to Hungary
  • non-Hungarian citizen may enter without restriction if the reason for the entry is a business activity
  • it must be credibly proven upon entry to Hungary

3. Rules on transit:

  • non-Hungarian citizens arriving from abroad in passenger traffic may enter Hungary for the purposes of travelling if they subject themselves to medical examination on entry, and the medical examination result obtained is negative for the COVID-19 infection
  • further conditions of the entry:
    • shall fulfil the conditions of entry prescribed in the Schengen Borders Code
    • credibly prove the purpose of their travel and the destination country
    • ensuring that they are allowed to enter the destination country

 Notification obligation for strategic companies:

  • issued as of 30 October 2020
  • the deadline has been extended, the notification obligation which is mandatory for strategic companies in connection with legal transactions concluded by 30 June 2020 instead of 31 December 2020
  • there is no notification obligation for affiliated companies

Public transport

In Budapest, as well as in the cities with county status, public transport services are to be provided more frequently on working days between 7 am and 9 am, and between 3 pm and 7 pm

Parking fees do not need to be paid:

  • as of 4 November 2020, there is no parking fee payable in public places
  • from 7 November 2020, in a residential area, a commercial parking facility can be used without paying a parking fee from 7 pm to 7 am
  • between 23 November and 11 December 2020, from 7 pm to 7 am, the surface parking lots in the public area of governmental bodies and governmental owned companies can be used free of charge by anyone.

Teleworking regulation during the state of emergency:

  • government decree in force from 12 November 2020 allows teleworking rules to be applied to the home office
  • the employer and the employee have the possibility to deviate from the rules of the Labour Code on telework by agreement
  • during the state of emergency, the special occupational safety regulations pertaining to teleworking specified in the Act on Labor Safety do not need to be applied
  • it is sufficient if the employer informs the employee about the rules on safe and non-hazardous working conditions

 Protected purchase period:

  • persons only over the age of 65 can visit the grocery stores, drugstores, and pharmacies from 9 am to 11 am Monday to Friday, and from 8 am to 10 am on Saturdays and Sundays
  • a person over the age of 65 is free to visit grocery stores, drugstores, and pharmacies outside the protected purchase period

Expiration of official documents:

  • expiring official documents issued by the Hungarian authority are valid for 60 days after the end of the state of emergency
  • there is no place to replace an expiring document
  • the new period of validity does not need to be entered into the register neither indicated on the document

It is not mandatory to wear a mask during rest breaks

  • The employer and the employee may agree that, while working in the shop, the employer shall provide a rest break during which the employees do not need to use the mask
  • During a break, the employer may only designate a room:

(a) which is not used to store products sold in the shop

(b) in which the buyer may not be present
