On 12 March 2020, the Federal Ministry for Economic Affairs amended the export and transfer prohibition of certain medical safety equipment dated 4 March 2020 (“Order”).
The major amendments concern the scope of the application of the Order and the cases of permissible export licences. The Order clarifies that it is not applicable to cases of transit. Further, the Order does not cover listed items if these items are integral part of another item.
An application for export or transfer can be submitted filed for in cases, if listed items are necessary for the maintenance of subsidiaries of companies seated in Germany. Further, the Order considers the needs of the neighbour states in the European Union and the EFTA and allows export and transfer in order to secure coverage of the essential demand. Moreover, the Order contains a general possibility for application in cases of hardship.
The Order is effective as of 12 March 2020.
