The Employees’ Compensation (Amendment) Ordinance 2021 gazetted – Expansion of ECO Coverage to “Extreme Conditions”

The Employees' Compensation (Amendment) Ordinance 2021 (the “Amendment Ordinance”) was gazetted on 30 April 2021 and has come into force on 2 July 2021.
The Amendment Ordinance extends the protection of the current Employees' Compensation Ordinance (Cap. 282) (the “ECO”) to cover situations where an employee sustains an injury or dies as a result of an accident when commuting to or from work during an “extreme conditions” announcement following a super typhoon or other natural disaster of a substantial scale.
Accordingly, if typhoon signal number 8 is lowered following the passing of a super typhoon and the announcement of “extreme conditions” (as declared by the Chief Secretary of Administration) is made, employees may still be covered by the ECO under this Amendment Ordinance as gazetted.
Employers are reminded to review their insurance policies on extreme weather conditions in due course to ensure they have sufficient coverage.
