Revised EU thresholds regarding public procurement and concession contracts, with Belgian specifics

The European Commission has revised the thresholds relating to the award procedures of public contracts and concession agreements by means of four separate Commission Delegated Regulations, adopted on 30 October 2019, which entered into force on 1 January 2020. (1)

The European Commission is to verify every two years that the threshold for concessions and public contracts as set out in the relevant Directives, still correspond to the thresholds established in the World Trade Organisation Agreement on Government Procurement (herein after “GPA”) concluded in the framework of the World Trade Organization. The European Commission thus calculates, In accordance with the calculation method set out in the GPA, the value of these thresholds on the basis of the average daily value of the euro in terms of the special drawing rights (SDRs), over a period of 24 months terminating on 31 August preceding the revision with effect from 1 January. (2)

The European Commission also determines every two years the values of the thresholds, in the national currencies of the Member States, whose currency is not the euro. In accordance with the calculation method set out in the GPA, the determination of such values shall be based on the average daily values of those currencies corresponding to the applicable threshold expressed in euros over the 24 months terminating on 31 August preceding the revision with effect from 1 January. The new thresholds are the following:

With regard to concessions (4)

The threshold of EUR 5 548 000 is revised downward to EUR 5 350 000.

With regard to public procurement (5)

The threshold of EUR 5 548 000 is revised downward to EUR 5 350 000.

The threshold of EUR 221 000 is revised downward to EUR 214 000.

The threshold of EUR 144 000 is revised downward to EUR 139 000.

With regard to public procurement in the utilities sector (6)

The threshold of EUR 5 548 000 is revised downward to EUR 5 350 000.

The threshold of EUR 443 000 is revised downward to EUR 428 000.

With regard to public procurement in the field of defence and security (7)

The threshold of EUR 443 000 is revised downward to EUR 428 000.

The threshold of EUR 5 548 000 is revised downward to EUR 5 350 000.

These new thresholds apply as from 1 January 2020 and are directly applicable in all Member States. (1)

For Belgian procurements and concessions, the new thresholds apply as from 1 January 2020 for

  • procurements and concessions that are announced or should have been announced from 1 January 2020;
  • procurements and concessions procedures without prior publication, where candidates have been invited to submit their tender from 1 January 2020. (8)
