The lack of a genuine and actual or foreseeable terrorist threat releases air carriers from liability for not transmitting PNR data.
On June 21, 2022, the Court of Justice of the European Union ruled that the PNR Directive is compatible with the Charter of Fundamental Rights of the EU. The ruling was a response to a preliminary question from the Belgian constitutional court. The CJEU emphasized that acts of the Union should be interpreted, as far as possible, in a way that does not undermine their validity and is consistent with primary law as a whole - in particular, the provisions of the Charter of Fundamental Rights of the EU.
