Nawet jeżeli na przykład w ogłoszeniu o zamówieniu nie przewidziano uprawnienia do obniżenia ceny, to wynika ono bezpośrednio z kodeksu cywilnego i może dotknąć każdego wykonawcy wadliwie realizującego zamówienie.
