Co dalej z PNR-ami? Skutki orzeczenia TSUE

Brak rzeczywistego i aktualnego lub przewidywalnego zagrożenia terrorystycznego zwalnia przewoźników lotniczych z odpowiedzialności za nieprzekazanie danych PNR.

21 czerwca 2022 roku Trybunał Sprawiedliwości Unii Europejskiej orzekł, że Dyrektywa PNR jest zgodna z Kartą praw podstawowych UE. Orzeczenie było odpowiedzią na pytanie prejudycjalne belgijskiego sądu konstytucyjnego. TSUE podkreślił, że interpretacja aktów Unii powinna być prowadzona, tak dalece jak to możliwe, w sposób, który nie podważa ich ważności i pozostaje w zgodzie z całością prawa pierwotnego – w szczególności z postanowieniami Karty praw podstawowych UE.
