Legal solutions for your technology outsourcing projects

The concept of outsourcing technology is not new. Outsourcing of technology infrastructure, systems and services is a strategic decision taken by many organisations, enabling an organisation to focus on its core business.

Many different approaches are taken, from externalising provision of IT helpdesks through to wholesale off-shoring, near shoring or other outsourcing of data centres, networks or other core technology functions. In addition, outsourcing of IT to cloud solutions is fast becoming a more mainstream option for businesses.

Cost and efficiency savings remain a significant driver for any outsourcing arrangement, but outsourcing has also become a powerful mechanism for driving business change, innovation, flexibility and procuring best in class service for businesses whether for their own business or for delivering services to their customers. As a result, the models have become more complex and the legal and risk factors more complicated.

Eversheds Sutherlands had an excellent grasp of the technology underlying the deal; were incredibly committed; extremely pragmatic and ensured a “win-win” for both parties which was second to none. They quickly understood our needs, culture/attitude to risk, putting together an effective team that ensured the project was delivered on time/ budget.

True technology lawyers

Eversheds Sutherland is recognised for its Outsourcing and Technology groups, with one of the strongest international non-contentious Technology and IT Outsourcing practices. We have approximately 75 lawyers who specialise in all aspects of IT and technology outsourcing law for both customers and suppliers, acting for both the private and public sectors, both on a local country basis and in relation to global deals.

We have 20+ partners who specialise in IT law with most of them recommended or recognised as leading individuals in Chambers and/or the Legal 500. Our lawyers help their clients shape and lead the market. Our team are true technology lawyers, working on cutting edge deals and models with our clients and, in this way, can help you ensure a market-ready and future proofed contract.

In 2012, we commissioned a study into adoption of cloud technologies with PA Consulting Group. Our findings were that many companies perceived technical, commercial and legal (including contractual) barriers to entering into cloud deals. The perceived barriers are still there. Eversheds Sutherland's role on cloud deals is to help ensure the contract put in place holds no strong legal barriers to adopting the technology solution and that the business understands the legal risks involved.

Eversheds Sutherland's commercial pragmatism and deep understanding of the technology world is considerable, and they are one of the few law firms who genuinely invest in a personal, and long term, relationship. I have always been exceptionally impressed with the outstanding support Eversheds has provided Nomura time and time again.
