The Eversheds IT projects team is advising on major IT projects in the public sector, typically those are major IT outsourcing projects of a complex or high-value nature, IT-enabled business process outsourcing or major system software development projects within the public sector. Those are usually in the central government sector, sometimes in local government, we’ve also got a particular specialism in policing and we also undertake work in the education sector for universities and similar organisations.

The sort of role we perform on these projects is advising on the procurement strategy and structuring and approach to ensure that a successful project is achieved and the right partner is chosen. We also advise along with our procurement colleagues on the procurement documentation that is used, and reviewing that to make sure it’s right and compliant. We advise on contractual structures and on drafting and putting in place the right contract again to ensure successful delivery of the project. We also advise on some of the more technical commercial schedules, working alongside the commercial advisers, the technical advisers, financial advisers in a joined-up, seamless way because you can’t look at the legal issues in isolation from the technical and commercial issues that drive the project.

We will also lead or support the client or its other advisers in leading the dialogue or negotiation on the project and contractual matters. We will manage support from wider specialists like, for instance, Due P and pensions, and we also are engaged in the processes of working with stakeholders and in assisting the client through the Government’s processes that need to get these projects signed off.
