We work with virtually every type of captive and are deeply familiar with captives domiciled in all the key jurisdictions, including the United States, Bermuda, Barbados, Jersey, Guernsey, Gibraltar, Isle of Man, and the Cayman Islands. Eversheds Sutherland advises captives owned by single parents and by multiple unrelated entities, including risk retention groups and those sponsored by governmental entities. We work closely with major insurance brokers and other captive advisors and have longstanding relationships with captive managers, accounting firms, and regulators in key captive jurisdictions.

We assist in forming captives as stock companies, mutual companies, and reciprocals. In addition, we have been involved in forming, and we continue to represent, many cell and similar operations. From their inception, we have represented the two earliest pooling arrangements among captives. In addition to our extensive knowledge of and experience with insurance regulatory and tax issues, we draw on our colleagues who work in finance, securities, commodities, and accounting to advise and counsel clients. This multidisciplinary approach enhances Eversheds Sutherland’s ability to effectively and efficiently represent clients in using captive structures to transfer and finance risk.
