Social Media - European employment approach

We recently invited colleagues in Eversheds Sutherland's offices across Europe to update their information about social media use and restrictions in their respective jurisdictions. Whilst use of social media and the blurring it can create between home and work life has been an issue for many years now, it seems only latterly that employers across Europe are opting to introduce internet or social media use policies. Even now, many choose not do so, despite an increasing prevalence of employee business profiles online.

Those employers which communicate behavioural standards to their workforce are inevitably better-placed to enforce those standards, if necessary through dismissal. Despite this, it would appear that generic employment laws, governing the rights of an employer to discipline or dismissal for misconduct, continue to operate reasonably effectively in most countries contacted when it comes to challenging inappropriate internet use by employees.
