Wierzbowski Eversheds Advised Motorway Authority in Negotiations for Financing of the Construction of A2 Motorway

    On 29 June 2009 the Minister of Infrastructure, Autostrada Wielkopolska II S.A. and its shareholders, the European Investment Bank and a number of commercial banks, signed the financial closing agreements for financing of the construction of a 106 km section of the A2 Motorway between Świecko and Nowy Tomyśl. These agreements enable the start of construction work so that the A2 Motorway can connect Poland to the network of European motorways prior to the UEFA Euro 2012 football championship.

    Our lawyers advised the Motorway Authority (GDDKiA) during negotiation of these agreements. Previously our firm represented GDDKiA during the negotiations leading up to signing in 2008 of the agreement for construction and operation of this section of the A2 Motorway – the commercial closing.

    This landmark investment will be based on a PPP model. The value of the project is about EUR 1.6 billion.

    Financing will come from three sources: the European Investment Bank (about 62.5% of the project value), 11 international commercial banks (about 25.5%), and contributions by the shareholders of Autostrada Wielkopolska II S.A. (about 12%).

    Construction work is to begin in July 2009, and the entire section of the motorway is to be put into service prior to the UEFA Euro 2012 football championships. It will be the longest concrete motorway in Poland.
