Wierzbowski Eversheds advises Polish motorway authority on toll collection system

    On 2 November 2010 the General Directorate for National Roads and Motorways (GDDKiA) and the Kapsch consortium signed a contract for design, delivery and operation of the national electronic toll collection (ETC) system for Poland. The value of the contract is PLN 4.9 billion (approx. EUR 1.5 billion). The system is to be ready by 1 July 2011.

    The ETC system will ultimately cover about 2,000 km of motorways, 5,000 km of expressways, and 600 km of national roads. Trucks and buses (vehicles above 3.5 metric tons) will be required to use ETC, while drivers of passenger cars may join the system on a voluntary basis. The fee schedule and technical details will be determined at a later stage.

    Wierzbowski Eversheds represented GDDKiA in the transaction. Lawyers from the firm participating in the project were Grzegorz Rudnicki, Tomasz Zalewski, Anna Ochocka, Anna Lesiak, Michał Drozdowicz and Agnieszka Chylińska. Our lawyers supported GDDKiA throughout the process leading up to signing of the contract, starting from preparation of the feasibility study, through drafting the tender documentation, conducting the public procurement procedure, and representation before the National Appeal Chamber.
