Wierzbowski Eversheds to advise PKP PLK S.A.

    On 15 May 2013, PKP Polskie Linie Kolejowe S.A. signed an agreement to update a feasibility study for a new rail connection to Zakopane and Nowy Sącz, with a consortium of Ernst & Young Corporate Finance Sp. z o.o., WS Atkins Sp. z o.o. and Wierzbowski Eversheds Sp. k.

    The offer of the consortium of which our law firm is a member was found to be the most advantageous out of seven bids submitted in the public procurement procedure. Our lawyers also conducted a proceeding on behalf of the consortium before the National Appeal Chamber in connection with an appeal filed by competing prospective contractors.

    The value of the procurement, which under the agreement is to be performed within 35 months, is PLN 4,835,130. After indicating a financial model under which the project will be profitable, the feasibility study will conclude with submission of an application for a decision on environmental conditions, a procedure for selection of the private partner for the project, and preparation of an application for EU funding, among other measures. The members of the consortium will prepare the documents necessary to announce the tender for drawing up the design documentation necessary to build the new connection and will provide expert support to the contracting entity.

    Work on the project by the team at our law firm was coordinated by Tomasz Korczyński, with support from Krzysztof Wierzbowski, Arwid Mednis and Jakub Sikora. The proceeding before the National Appeal Chamber was led by Piotr Kunicki.
