Dr Aleksandra Kunkiel-Kryńska and Marta Gadomska-Gołąb co-author commentary on consumer law

Consumer Law: Commentary has just been published (in Polish) by C.H. Beck. Dr Aleksandra Kunkiel-Kryńska and Marta Gadomska-Gołąb, the partners heading the commercial practice at Wierzbowski Eversheds Sutherland, are the co-authors of two chapters. The volume, edited by Dr Konrad Osajda, LL.M., is the most comprehensive commentary on the system of consumer law in Poland and the European Union.

Dr Aleksandra Kunkiel-Kryńska together with Dr Aneta Wiewiórowska-Domagalska wrote the chapter on unfair market practices, and with Marta Gadomska-Gołąb co-authored the chapter on the Act on Information on Prices of Goods and Services.

The work is the most extensive commentary on these regulations available in Poland. The authors present the overall set of legal issues connected with practical application of particular provisions of the key acts of consumer law as well as doubts in interpretation and the relationship between European law and national law in this area. The work cites a wealth of case law from the Court of Justice of the European Union, the Supreme Court of Poland and other courts, as well as the views expressed by legal scholars.

The work addresses numerous issues never before raised in the legal literature. In their commentaries on the law, the authors consider various hypothetical applications which could arise in practice, or where the practice could give rise to similar situations where the legal analysis would be relevant. The authors’ aim is not only to explain the meaning of particular provisions of consumer law and existing, established practices of applying the law, but also to uncover potential issues of interpretation lurking in the provisions which could be relevant for resolving complex and difficult cases.

The commentary is the work of over a dozen legal scholars at universities in Poland and abroad, including advocates, legal advisers, and specialists at the Supreme Court of Poland and the Court of Justice of the European Union.

Consumer Law: Commentary is the latest work co-authored by Dr Aleksandra Kunkiel-Kryńska. She is also the co-author of Unfair Clauses in Consumer Contracts (C.H. Beck, 2004 & 2005), the author of Methods for Harmonizing Consumer Law in the EU and Their Impact on Implementation Processes in the Member States (Wolters Kluwer, 2013), and the co-author of Consumer Law in Practice (C.H. Beck, 2016) (all in Polish). Together with Marta Gadomska-Gołąb, she is also the founder and co-author of the regulatory blog W ramach regulacji, launched by Wierzbowski Eversheds Sutherland in June 2019.
