Eversheds Ots & Co advised successfully Construcciones y Auxiliar de Ferrocarri in the matter concerning procurement of trams for Tallinn

    Law Office Eversheds Ots & Co successfully represented Construcciones y Auxiliar de Ferrocarri (CAF), Spain, at courts of every instance in connection with their dispute with Stadler Bussnang AG concerning procurement of new trams for Tallinn.

    The estimated value of the procurement announced in the summer of 2012 is 44.25 million euros and the objective of the procurement is to purchase at least 15 new trams for Tallinn. As a result of the tender review process the tender submitted CAF, Spain, was declared successful; furthermore it was decided that the tender submitted by Stadler did not comply with the contract terms. Stadler first contested the decision on rejecting their tender at the Public Procurement Appeals Committee, and thereafter at courts of every instance. Both the Appeals Committee, as well as the courts dismissed the appeals of Stadler. After that Stadler further contested the decision on declaring the CAF’s tender compliant and successful at the Appeals Committee and at each of the court instances, seeking also that the public contract entered into with CAF be declared null and void. Both the Appeals Committee, as well as the courts dismissed the appeals of Stadler.

    CAF was represented at each of the court instances by the law office Eversheds Ots & Co. The team advising the client was headed by the attorney-at-law and partner Raiko Lipstok.
