Eversheds Sutherland advises Encavis on the acquisition of UKA's Warnsdorf wind farm

    The international legal practice Eversheds Sutherland has provided tax law and tax structuring advice to Encavis Asset Management AG as the buyer of the Warnsdorf wind farm planned by the energy park developer UKA.

    The wind farm located in Warnsdorf in the German federal state of Brandenburg went into full operation in spring 2021. The twelve wind turbines with a combined output of approximately 43 megawatts produce sustainable energy for over 40,000 households. The project is a repowering project whereby twelve outdated turbines from the year 2001 were replaced with modern turbines.

    Encavis AG is a producer of power from renewable energies listed in the MDAX on the German stock exchange. As one of the leading independent power producers, Encavis purchases and operates solar parks and (onshore) wind farms in ten European countries. Within Encavis group, Encavis Asset Management AG specialises in the area of institutional investors.

    UKA plans, builds, manages and operates wind and solar parks including the associated infrastructure. The company which was founded in 1999 is one of Germany's leading developers with approximately 60 energy parks connected to the grid and an international project pipeline of four gigawatts. As a full-service provider, the group of companies provides all services up to the turnkey handover of the facilities.

    Encavis selected the German tax law team of Eversheds Sutherland for the first time in the context of its acquisition of the Warnsdorf energy farm. The Partner Dr. Simon Weppner (Dusseldorf) and Martina Sradj (Of Counsel, Munich) advised the client on this matter.
