On 16 July, the amendment to the Market Surveillance Act adopted in May 2020 will enter into force, which makes it more widely mandatory to provide instructions to products.

• What does the current legislation say?
Under the current legislation, manufacturers are obliged to provide instructions for use and handling and safety warnings when required by law or safety standards. In practice, this has been the case, for example, for children's toys and electronic equipment.
• What is going to change from 16 July?
In general, it is mandatory to provide consumers and other end-users with instructions for use and handling in Hungarian, as well as warnings on safety for the product.
• Which products are affected by the change?
The obligation covers ‘products’ defined in Act LXXXVIII of 2012 on the Market Surveillance of Products (Market Surveillance Act).
Product means any movable tangible property intended for consumers and users and supplied or made available in the course of a business activity, whether or not for consideration, whether new, used or reconditioned. Foodstuffs, feeding stuffs, live plants and animals, preparations of human origin or preparations of plant or animal origin directly related to the reproduction of plants or animals, and goods and services covered by the Law on Electricity, Gas Supply and District Heating are excluded from the definition of products.
• Who is responsible for ensuring that instructions for use and handling are included?
Basically, the manufacturer is responsible.
However, if the manufacturer or importer has failed to comply with this obligation, the distributor of the product must make good this failure.
• What about online instructions?
According to the reasoning of the amending law, instructions for use and handling can also be provided online.
