Eversheds Sutherland advises SSE and RWE on the development of an offshore wind farm

Eversheds Sutherland has advised SSE Renewables and RWE on their joint-venture to develop a 150km2 offshore wind farm extension in the southern North Sea.

Eversheds Sutherland’s Real Estate Energy team advised North Falls Offshore Wind Farm, a 50:50 joint-venture between SSE Renewables and RWE, to lease and develop an extension to the operational Greater Gabbard Offshore Wind Farm. The team advised on the negotiation and subsequent agreement to lease the site from The Crown Estate.

The 150km2 site is approximately 20km from the UK’s east coast in the southern North Sea, and is adjacent to the existing 504 megawatt Greater Gabbard, opened in 2013.

The agreement for lease follows an extensive process, including an application procedure for wind farm operators to extend existing projects, which closed in May 2018, and a Habitats Regulations Assessment undertaken to assess the possible impact of the proposed wind farm extensions, which concluded successfully in August 2019.

The Eversheds Sutherland team was led by James Trafford, Partner, Real Estate and James Shawe, Principal Associate, Real Estate.

    James Trafford, commented:

“SSE and RWE, both longstanding clients of ours, made enormous commitments to develop the UK’s renewable energy capacity, and I am delighted that Eversheds Sutherland advised both on the agreement for lease for North Falls Offshore Wind Farm. This project demonstrates the UK’s commitment to wind energy and builds on the mature offshore wind market in the United Kingdom which sees it as a world leader in delivering offshore wind technology.”

Martin Whyte, Project Manager for North Falls Offshore Wind Farm, commented:

“The North Falls team very much appreciated the benefit of Eversheds Sutherland’s long experience and in-depth knowledge as they advised us on these key agreements. Having these agreements in place is a key pre-requisite for the project, so Eversheds Sutherland were invaluable to helping us pass this milestone. We are now looking forward to commencing the project development works in earnest.”
