Restructuring - a guide to the key legal issues and practical considerations

This course is aimed at those who may be involved in reorganisations that may result in redundancies or transfers of staff to other organisations. The course will look at the legal principles involved, the practical approach to take and the how to minimise or reduced risks in the workplace when effecting these reorganisations.

Synopsis

Restructuring is an important issue in the current economic climate. Institutions are facing uncertainty over the impact of Brexit on areas such research funding and student recruitment and fees, potential important changes to tuition fees and comments by the OfS to the effect that they will not “bail out” higher education providers who are in financial difficulty.

When you factor in the forthcoming insolvency regime for FE and sixth form colleges and concern about the future funding at FE level, it’s easy to see why all institutions are in the position where they may need to consider options to restructure their workforce, whether in terms of numbers or their contractual duties

In this session we will explore topics such as:

  • when does change amount to a redundancy situation
  • when do you need to collectively consult?
  • key considerations in changing terms and conditions of employment.
  • how to act reasonably in a redundancy situation
  • what are the common problem areas and how do you manage them?
