Synopsis

Higher education institutions and further education colleges continue to face close scrutiny of the compliance of their student contracts with consumer law, not just from the Office for Students, Office of the Independent Adjudicator and Competition & Markets Authority but also from students who are increasingly aware of their consumer and contractual rights and ready to challenge institutions where they perceive they have not been afforded those rights.

Higher education institutions and further education colleges continue to face close scrutiny of the compliance of their student contracts with consumer law, not just from the Office for Students, Office of the Independent Adjudicator and Competition & Markets Authority but also from students who are increasingly aware of their consumer and contractual rights and ready to challenge institutions where they perceive they have not been afforded those rights.

A number of important legal and regulatory concerns arise which, if managed robustly by institutions, can lead to advantages such as increased student recruitment, retention and success and enhancement of the student experience, but which if mis-managed can result in a poor student experience, loss of income and reputational damage.

This panel-style session will provide a forum for high level discussion of these issues and will assist institutions to identify best practice. It will be chaired and facilitated by two of our legal experts specialising in student contract and consumer law.

Issues for discussion will include:

− when is the student contract formed?

− what is the “fairness” test under consumer law?

− when might something said to prospective students at open days or by overseas agents become a term of the student contract?

− when must an institution give a student a statutory right to cancel the contract, and what are the implications of not doing so?

− what statutory remedies do students have under consumer law?

− how can institutions look to ensure they have lawful rights to make changes to courses or to fees?

− when can the student contract be terminated, and by whom?

− how should student contracts align with accommodation contracts and collaboration arrangements?

− how should student protection plans align with student contracts?

− when might failure to comply with consumer law give rise to potential criminal liability for institutions
