Education webinar - Disability discrimination and reasonable adjustments

Synopsis

In 2022 more employment tribunal claims were brought for disability discrimination than for any other protected characteristic. This reflects what we see in practice in acting for institutions, with claims for discrimination arising from disability and failure to make reasonable adjustments being particularly prevalent.

Often requests for adjustments will be first be raised internally. So how should institutions deal with these fairly and minimise the risk of successful claims?

In this webinar we will cover:

  • how difficult is it to satisfy the definition of disability?
  • a reminder of types of discrimination disability has in common with the other protected characteristics – direct, indirect, harassment and victimisation
  • a focus on the extra ones - discrimination arising from disability and the duty to make reasonable adjustments
  • types of adjustment – physical adjustments and equipment; non-physical adjustments – hours, location, performance
  • tricky issues – do you say “no” unless you have to say “yes”? Cost : how much is too much? Precedent : if you do it for one…? Maintaining adjustments : for how long?
