Synopsis

The #MeToo movement obtained worldwide support in 2017 and 2018 following a number of high-profile scandals and revelations. It continues to gain momentum, particularly now that the government begins to propose and implement legislation to address the outcry and calls for change.

It is fair to say that with increased awareness and employee empowerment, employers are facing an increased risk of grievances and claims and the potential for serious reputational damage.

These developments have therefore raised a number of issues for employers, including the following:

  • What amounts to sexual harassment under the Equality Act 2010?
  • How prevalent is sexual harassment in the workplace?
  • What lessons can be learned from case law?
  • Is it still possible to require employees to sign NDAs as part of our settlement agreements?
  • What further changes to the law can we expect?
