At 11pm on 29th March, the UK is scheduled to leave the European Union. This will mean the right of free movement enjoyed by workers within the EEA and Switzerland to come to work in the UK and bring their family, and the rights of British nationals to work in the EEA and take their family to work, will no longer be automatic.

In anticipation of this, the Government’s long-anticipated White Paper regarding the UK’s future immigration system was published shortly before the Christmas holidays and makes important proposals regarding how a new immigration system should operate.

The immigration position after 29th March remains uncertain for employers. In the absence of an agreement of the terms on which the UK will leave the European Union, it may be that new provisions are introduced before the proposed transitional arrangements were set to end in 2020.

This briefing is intended to introduce the key provisions of the immigration White Paper, explain our experience of the EU Settlement Scheme to date and advise of key issues which HR teams need to monitor in the coming months.
