Introduction to UAE employment law and DIFC

Who should attend

This Introduction to UAE employment law course is relevant to international HR managers and directors with responsibility for employees in the UAE. It will also be useful to managers and directors who anticipate entering the UAE market and who need to be aware of their responsibilities to their people.

Synopsis

Our course is designed for employers in the UAE. Our virtual session on Day 1 (4 May 2021) will consider the laws which apply to most UAE based employers in the UAE (onshore and free zones) and Day 2 (6 May 2021) will consider the laws of the Dubai International Financial Centre (DIFC) for DIFC based employers.

Both days' session covers the general position with regards to right to work in the UAE and the cultural nuances which apply in the UAE but then go on to separately consider the key employment rights and entitlements of employees in the UAE by reference to which law governs their employment relationship (i.e. UAE Labor Law or DIFC Employment Law).

Please note that our course programme will run over two days from 09:30 to 12:30 (GMT).

The course fee for the full course (4 May and 6 May 2021) is £449 (plus VAT). Alternatively you can elect to attend the virtual session on Day 1 or Day 2 only. The 'day only' fee is £249 (plus VAT).

UAE Labor Law

Background

  • Legal framework in the UAE
  • Overview of free zone system
  • Right to work and visas
Recruitment – key considerations
  • Emiratisation (i.e. employment of UAE Nationals)
  • Standard form employment contracts and relevance of contract term (limited or unlimited)
Key Employment Rights and Entitlements
  • Probation, notice and contract term
  • Working hours, rest breaks and overtime
  • Annual leave and public holidays explained
  • Maternity and paternity leave
  • End of service gratuity on termination
  • Rights on termination

Termination of employment

  • Lawful grounds for termination
  • Special dismissal protection – women on maternity leave and nationality specific protections
  • Compensation for “unlawful” terminations
  • Visa considerations on termination
  • Claims and the Labor Court

 

Day 2

DIFC Employment Law

  • Legal framework in the UAE
  • Overview of how the DIFC differs from onshore UAE
  • Right to work and visas

Recruitment – key considerations

  • Emiratisation (i.e. employment of UAE Nationals)
  • Obtaining residence visas and work permits

Key Employment Rights and Entitlements

  • Probation, notice and contract term
  • Working hours, rest breaks and overtime
  • Annual leave and public holidays explained
  • Maternity and paternity leave
  • Mandatory pension contributions (which replaced end of service gratuity)
  • Rights on termination and anti-discrimination provisions

  • Protected Characteristics

Termination of employment

  • Lawful grounds for termination
  • Special dismissal protection – women on maternity leave and discrimination
