Consequences of Personal Data Protection Act Fiasco: Fumbling of Politicians Has Caused Legal Void

The withdrawal of the draft Personal Data Protection Act has put on hold the full implementation of the General Data Protection Regulation and has created uncertainty within the legislative framework governing protection of personal data. 

On 13 June the draft Personal Data Protection Act was withdrawn from the legislative proceeding of the Parliament of Estonian. We all know the reason for it. Several political parties saw the draft Act as an attempt to endanger media freedom, as it allowed the media to process personal data without data subjects’ consent in cases of predominant public interest, much in the same way as they have under the current Act adopted in 2007. Politicians were quite vexed with the fact that under the new EU Personal Data Protection Act public interest needs not be predominant, just ... public interest.
