Mutual Responsibility in the Construction Process: Key Issues for Contractors

A workshop entitled “Mutual Responsibility in the Construction Process: Key Issues for Contractors” will be held on 27–28 May 2015 at the Westin Warsaw Hotel. The event is organized by MMC Polska.

Among the issues to be covered at the workshop are:

  • Warranty and guarantee under new rules
  • Using subcontractors in the development and construction process under the Public Procurement Law
  • The contractor’s principal claims against the investor under a construction works contract (including FIDIC contracts).

Our law firm will be represented by Agnieszka Chylińska, an attorney from the real estate, infrastructure and public-private partnership practice, and Tomasz Zalewski, Head of the public procurement team, who will give a presentation entitled “Issues of Construction Contracts Performed by a Consortium,” covering such areas as:

  • Joint and several liability to the investor
  • Internal dealings between contractors
  • Liability to subcontractors
  • Division of the scope of work—consortium agreement and construction contract
  • Resolving disputes within the consortium—termination of the consortium agreement or construction contract, revocation of power of attorney, and consequences with respect to the investor.
