EuroZamówienia Procurement Academy: Bid-rigging and reliance on the resources of third parties and subcontractors 
We invite you to attend the second training event this autumn in our series of business breakfasts which we call the EuroZamówienia Procurement Academy. The event will be held on 26 November 2015 from 9:00 to 10:30 am at the offices of Wierzbowski Eversheds, Centrum Jasna, ul. Jasna 14/16A, Warsaw. 

We invite you to attend the second training event this autumn in our series of business breakfasts which we call the Procurement Academy. The training will be devoted to bid-rigging and reliance on the resources of third parties and subcontractors. It will be held on 26 November 2015 from 9:00 to 10:30 am at the office of Wierzbowski Eversheds, Centrum Jasna, ul. Jasna 14/16A, Warsaw. 

For several years bid-rigging has remained one of the hottest topics in public procurement. The competition and consumer protection policy adopted by the Polish government in September 2015 demonstrates that combating bid-rigging will be one of the top priorities of the Office of Competition and Consumer Protection. The regulator also plans to develop its own program aimed at uncovering illegal arrangements in tenders conducted under the Public Procurement Law. The program will create analytical tools and methods for catching signals of possible irregularities. This makes it vital for contractors to ensure that their actions are above reproach in all aspects of public procurement involving dealings with other economic operators, whether within consortia or under other legal relationships, in particular with subcontractors and third parties lending their resources for purposes of winning public contracts. 

During the business breakfast we will discuss: 

  • How does the regulator intend to uncover bid-rigging? 
  • What actions by contractors are likely to rouse suspicions?
  • The consortium as a form of bid-rigging
  • Reliance on the resources of third parties and subcontractors in the context of bid-rigging
  • Appeal strategy and the risk of allegations of bid-rigging
  • How to defend against bid-rigging allegations?
