Experience

Adam Nierzwicki is an attorney at law with the labor law team at Wierzbowski Eversheds Sutherland. He specializes in employment law and also has experience in social insurance law and data protection law.

He advises clients on all aspects of labor law, in particular concluding and terminating employment agreements (including group layoffs), staff transfers, employment aspects of M&A transactions, and non-competition agreements. He represents employers in litigation with employees and the Social Insurance Institution.
He is also experienced in the law of social insurance and processing of employees’ personal data.
He is the author of articles on employment law in such publications as Rzeczpospolita. He is also a co-author of the employment blog Kodeks w pracy.
Adam completed the program of the American Law Center, offered by the Faculty of Law and Administration at the University of Warsaw in conjunction with the University of Florida.

| Advising on restructuring and group layoffs, including a collective labor dispute and negotiations with the labor union on the group layoffs agreement and successful representation of the employer in litigation initiated by employees claiming damages for unlawful termination
| Advising on restructuring and assisting during the group layoff process and voluntary attrition program, including drafting necessary documents, participation in the information and consultation process with employee representatives, negotiating the group layoff agreement, and assistance in resolving issues of individual laid-off employees
| Advising on succession of accident insurance premium after transfer of employees and effective representation of social insurance remitters in litigation seeking to confirm the succession of the premium by the new employer
| Auditing a company’s employment documentation and practices
