Krzysztof Wierzbowski is the senior partner at Wierzbowski Eversheds Sutherland. He heads the real estate and infrastructure practice.
He is one of the pioneers of business law in Poland. From the early years of the free market he was involved in privatisations and restructurings of Polish companies and pioneering projects for financing large investments. He has advised foreign investors, banks, international financial institutions, National Investment Funds and the Ministry of Privatisation. He has participated in numerous reorganisations, mergers and divisions of international companies.
Until the end of September 2017 he was the managing partner at Wierzbowski Eversheds Sutherland.
Krzysztof has particular experience in the field of telecommunications, including projects shaping the telecommunications market in Poland. In 1991, he participated in the negotiations to create the country’s first mobile operator, PTK Centertel, subsequently he was working for the company for many years. Krzysztof has represented PTK Centertel and Telekomunikacja Polska (currently Orange Polska) and many other clients in regulatory, administrative and judicial disputes and competition matters, including precedent-setting antitrust cases.
He has advised Polish and foreign companies on complex infrastructure projects. Among other matters, he represented the General Directorate for National Roads and Motorways in negotiations of contracts for construction and operation of motorways and a build-operate-transfer contract for the national system of electronic toll collection.
Krzysztof has appeared in numerous court cases and international arbitration proceedings. Among other matters, he represented an American investor in a bilateral investment treaty dispute. He has represented foreign investors before the Court of Arbitration at the Polish Chamber of Commerce. He has advised the State Treasury in a number of infrastructure-related judicial and arbitration disputes in Poland and abroad. He represented one of the largest Polish companies in an IT dispute before an arbitral tribunal in New York.
On numerous occasions he has advised leading Polish and foreign companies on complex real estate projects, such as construction of factories, shopping malls, logistics centres, office buildings and residential developments.
Krzysztof Wierzbowski is an arbitrator at the Court of Arbitration at Polish Confederation Lewiatan (the most influential organisation representing the interests of Polish employers at home and in the EU) and a member of the European Advisory Board of the Institute for Conflict Prevention & Resolution. For several years, he chaired the Infrastructure Committee of the American Chamber of Commerce in Poland.
He is regularly recommended by Polish and international legal rankings. In 2018 he was named a
“Lawyer of the 30 Years”
for his distinguished contribution to the growth of the legal profession during the era of transformation in Poland.
Selected projects
- Advising General Directorate for National Roads and Motorways (GDDKiA) on the preparation, selection of the concessionaire and negotiations of a PPP project, covering design, construction, financing and operation of A1 motorway section Stryków – Pyrzowice and A2 motorway section Stryków – Konotopa
- Advising GDDKiA on the electronic toll collection project VIATOLL – from planning, through assistance in the procurement process, negotiations of the contract and advice
- Representation of the Polish State Treasury and the General Director for National Roads and Motorways in disputes under UNCITRAL Rules relating to the execution of agreements on the construction and operation of motorways
- Advising the Polish Ministry for Sports on a project relating to the organization of the UEFA football championship in Poland and Ukraine in 2012
