Pensions law in Belgium
Located near the capital of Europa, our Belgian pensions team is closely involved in both European and Belgian evolutions in the pension landscape. Due to the team’s close involvement in HR issues, they can also offer clients guidance on both aspects in a practical way.
The Belgian pensions team’s Stefan Corbanie and Bernd De Marrez are known for their direct, no nonsense approach. Our pensions lawyers have considerable experience working with foreign companies in Belgium, involving cross border operations and complex employment/pension issues. Furthermore, due to the importance of Brussels in the European pension landscape, they have developed considerable experience working with European pensions institutions. One example of this is their work on transferring several Irish pension schemes into a Belgian institution for occupational retirement provision (IORP) structure, and setting up an IORP with compartments in several countries.
The pensions team also often deals with questions from companies regarding the alteration of pension schemes, for instance winding up Defined Benefit schemes. Other day to day work includes:
- advising companies in collective and individual dismissals covering all employment and pension issues arising out of termination of employment contracts;
- pensions implications in restructurings and closure of companies; and
- advising on implementing changes to pension benefits, including advice on information and consultation obligations
