Competition law in France

Over the years, our Paris competition law team has gained significant expertise in all areas of competition law, notably with regard to :

  • Advising and assisting in relation to restrictive trade practices/concerted practices, abuse of dominant position, abuse of economical dependency, discriminatory practices and unfair competition.
  • Advice on restrictive trade practices including transactional advice on commercial cooperation, significant imbalance (déséquilibre significatif entre droits et obligations des parties) or termination of longstanding business relationship (rupture brutale de relations commerciales établies) (Book IV, Chapter IV, of the French Commercial Code).
  • Strategic advice in relation to compliance issues, in particular through the implementation of compliance programmes. Building on our experience, we have developed the “Competition Law Online Toolkit”, an online training tool designed to deliver the key principles of competition law.
  • Representation before the European Commission and before national competition authorities - assisting and defending companies in the context of contentious proceedings initiated by competition authorities (visits and inspections, hearings, answers to questionnaires and statements of objections and responding to legal action).
  • Advising in relation to mergers and acquisitions, as regards the reporting of said transactions (merger control) to the competent authorities in France and those at EU level.
  • Advising and assisting private and public companies in relation to state aid (notifying the European Commission and handling complaints and litigation before domestic and EU courts).

Our team in Paris has developed close relationships with the French competition authorities as well as the European Commission.

Our clients include large French and international companies in both the public and private sectors, more specifically in sectors such as audio-visual, energy, financial services, pharmaceutical sector and distribution.
