Eversheds Sutherland LLP article written by Julie Galbraith, Partner in Employment Law and Robert Dever, Senior Associate in our Tax Group titled, 'Pizzas, elephants and Uber; the on-going analysis of employees and contractors in Ireland' has featured in the latest Irish Tax Review.
Published by the Irish Tax Institute, the Irish Tax Review is Ireland’s leading journal on taxation issue and is read by over 7,000 online readers – Issue 3, 2022 is now available on a dedicated website .
The article details how the Court of Appeal overturned the decision of the Tax Appeal Commission and the High Court in relation to the status of pizza drivers for a Domino’s pizza franchise. The previous decision makers had deemed that the drivers were employees of the company each night that they turned up to deliver pizzas. However, the Court of Appeal decided by a 2 to 1 majority that the drivers were contractors and not employees.
