Our healthcare experience

Our dedicated healthcare unit has been acknowledged by clients and legal directories as dedicated professionals in providing niche legal advices to healthcare service providers.

The unit has extensive experience in advising and acting for public and private healthcare service providers, regulators, representative bodies and a wide range of businesses and organisations involved in the healthcare sector. We provide an all encompassing claims handling and risk management legal service.

We advise hospital management in terms of risk and crisis management, and clinical and corporate governance issues. We also assist and manage the defence of employer’s liability (EL), public liability (PL) and malpractice claims.

We provide a “one stop shop” legal service in response to issues arising for hospitals and clinicians, and are therefore best placed to meet all of their legal needs.

Contentious

The unit provides advice in the following areas:

  • Defending clinical professional negligence actions, instructed either by the clinicians directly or by their indemnifier and/or insurer.  Our extensive experience in this field allows us to draw on significant knowledge gained from the trials and settlements we have managed;
  • Assisting and managing the defence of employer’s liability (EL) and public liability (PL) claims. We are able to strategically and pragmatically manage significant file portfolios so as to meet clients’ needs;
  • Providing a full litigation and dispute resolution service with the support of our litigation department. Our team has vast commercial court experience.

Non-contentious

The unit provides advice in the following areas:

  • Providing an as-needed 24/7 on call telephone advisory service to deal with consent issues, ethical issues and confidentiality matters;
  • Health crisis management including assistance in formulating a structured and timely approach to the crisis arising, and legally advising and managing the process to conclusion;
  • Emergency applications including working with the Wardship office and families in respect of consent applications to progress matters in the patient’s best interest;
  • Clinical protocols - assisting in reviewing, and/or drafting hospital guidelines/protocols and advising in relation to their implementation;
  • Complaints handling, policy and terms of reference considerations.  Assisting service providers in complaints handling, relevant guideline reviews and assisting in drafting terms of reference where necessary;
  • Advising healthcare employers on employment related claims – including bullying and stress related matters;
  • Standards, regulations and legislation – providing advices to healthcare service providers in relation to their obligations to regulatory bodies (HIQA, HSE, etc), to practitioners in relation to professional standards (RCPI, ICGP, ABA, IMC, PSI etc) and to provide updates in respect of relevant legislation;
  • Freedom of Information/Data Protection – advising on the application to Freedom of Information and Data Protection Acts;
  • Providing representation at inquests, and if requested, de-briefing sessions and/or training sessions can be provided post Coroner’s Court hearings.

The team regularly produces and circulates client ezines, client alerts and hosts breakfast briefings on current topical matters which are of relevance to both our own healthcare clients and the greater healthcare community.
