Professional indemnity
Our specialist team has considerable experience in investigating, defending and managing all aspects of professional indemnity claims on behalf of professionals and their insurers.
We have gained considerable knowledge of a number of disciplines including:-
- Legal (Solicitors and Barristers)
- Financial (Accountants, Financial Institutions and other investment intermediaries)
- Construction (Engineers, Architects, Surveyors)
Our professional indemnity team works closely with other departments enabling the provision of immediate expert advice to the above disciplines in a cost effective and pro-active way.
Our team work as panel solicitors for international insurers who have underwritten a significant percentage of the Irish solicitors’ insurance market and also a number of self-insured top tier accountancy firms.
We adhere to stringent SLA terms, with regular claims reporting requirements. As such we are very familiar with insurer’s requirements on coverage issues, defence cost estimates, reserve estimates and we are required to give an accurate estimate of the likely outcome of the case together with the potential legal cost exposure.
From time to time Insurers may experience challenges in deciding whether a particular claim is covered by the policy or whether there has been a non-disclosure, misrepresentation or a breach of warranty which may result in a claim being declined or a policy avoided. The team advises insurers on policy coverage and subrogation issues. Whatever the nature of the risk or the claim, we can provide advice regardless of whether the claim is made under a product liability, employers’ liability, motor, professional indemnity, property, public liability policy, legal expenses or many other classes of insurance. We also provide policy interpretation advice on issues of non-disclosure, exclusions, subrogation, delayed notification, coverage, limitation and claims co-operation.
