Intellectual Property (IP)

The area of IP is subject to fast changing legal requirements. The ever more rapid technological advances have led to a stream of national and European legislation, which, incidentally, often lags behind the technological developments that it aims to regulate. An expert advisor with up-to-date legal knowledge who knows about new applications is therefore of great importance.

Our IP specialists keep a finger on the pulse and are aware of the latest developments in those dynamic areas. They are able to establish the link between legal substance and market developments and are leaders in finding innovative and pragmatic solutions.

The team of Eversheds Sutherland renders services to national and international market parties as well as non-profit organisations. International transactions are handled in close cooperation with experts of other branches of the Eversheds Sutherland network.

Intellectual property rights are increasingly regarded as important company assets. The associated (financial) stakes have increased accordingly. The professionals of Eversheds Sutherland are highly experienced in this area and regularly work together with colleagues of other Eversheds Sutherland offices. You can rely on them for sound advice and assistance in areas such as:

IP litigation

Our experts are seasoned litigators with experience in dealing with high-profile cross-border IP infringement litigation, both on the side of the IP holder and that of the alleged infringing party. Their experience ranges from classic IP rights, copyrights, trademarks, designs, trade names and patents, to adjacent topics such as disputes about trade secrets, domain names, portrait rights, advertizing and unlawful competition (slavish imitation)

IP advice

We advise our clients on (possible) infringement claims, not only focusing on the legal part but also taking our client’s business interests into account. This can often lead to a settlement or another outcome without having to go through legal proceedings. Our team also provide advice on IP restructuring and company license structures, while working closely with tax, valuation and transfer pricing specialists.

Transactional IP

M&A and divestures. One of the qualities of our trademark practice is its approach of a trademark as an asset requiring to take into account financial, taks, valuation, and monetization and strategy considerations.

IP Agreements

Drafting of (complex) IP license and transfer agreements

Branding Team

Our Branding Team is responsible for the management of our client’s trade mark and/or design portfolio’s. We assist with filing trademarks and designs, provide advice on clearance and registrations, advice on trade mark watches, handle opposition and cancellation proceedings and coordinate trade mark disputes in other jurisdictions. Our added value is that we are one of few Dutch IP practices that combine a ‘classic’ IP practice with a full-fledged branding team: this combination leads to an approach in which the experience of both our attorneys-at-law and our trademark attorneys is included.
