Competition

The Competition Law department comprises a team of highly skilled professionals with a solid experience in a wide range of sectors including, amongst others, food, energy, consumer goods, tourism, aviation, and pharmaceutical and chemicals.

The department’s activity mainly focuses on representing and defending clients in sanctions proceedings brought by the Spanish competition authority, the CNMC, particularly in relation to cartel infringements. In addition, it advises businesses involved in infringement proceedings for abuse of a dominant position as well as in relation to the implementation of competition law compliance programs. It also regularly advises on corporate agreements (joint ventures, R&D, joint production, distribution and franchises, among others).

The department regularly provides advice in relation to M&A transactions, particularly those involving large multinational companies, and works in close cooperation with other departments across the business.

Our services

Eversheds Sutherland Commercial, Corporate and M&A Law Department offers the following services:

  • merger control
  • preventative advice to businesses on competition matters (compliance programs)
  • representation and defence of clients’ interests before the Spanish competition authority (the CNMC) and the European Commission in investigation and sanctions proceedings as well as before the Spanish courts, both as regards agreements and practices that restrict competition and including cartel infringements and abuses of a dominant position
  • legal advice on state aid matters
