Property experience in the education sector

Estates are of obvious importance to institutions in meeting their strategic goals.

A major part of the student experience is coloured by the physical space in which the teaching and learning takes place.  We know from our experience that estates teams need to ensure that the estates strategy and management supports the institution’s overall strategy, delivering bespoke yet flexible, efficient yet inspiring spaces in which to learn.

We operate a dedicated education estates team, supporting our clients in all aspects of their estate, from day-to-day operation and asset management through to major developments and funding.  Our team provides you with expertise in significant capital redevelopment projects as well as in dealing with routine asset management work.  They are not, however, just property or construction specialists - they are all immersed in the education sector and understand what that means in terms of the issues you are likely to face.

Examples of our work include:

  • Disposal of redundant sites, often to developers, to ensure that best value is achieved;
  • Campus acquisition and development;
  • Construction advice on all aspects of development projects, including procurement, building and infrastructure contracts, PPP agreements, consultant appointments, deeds of novation, collateral warranties and parent company guarantees/bonds.
  • Advice on obtaining planning consents and appealing planning decisions;
  • Securing funding and tax efficient procurement strategies for any new build;
  • All aspects of estate management, including innovative uses to increase efficiency, including third party sharing and collaboration agreements;
  • Title advice, to ensure that sites are fully owned and registered and dealing with material encroachments or third party rights affecting continuing future plans;
  • Advice on mitigating and, where possible, eliminating risks to your estate, including Town and Village Green applications and third party prescriptive rights;
  • Property litigation advice in relation to disputes with third parties such as neighbouring owners, landlords or tenants, including advice on eviction;
  • Advice on all aspects of student accommodation provision, including development projects, commercial nominations agreements with third party providers, student accommodation contracts, disputes and eviction;
  • Agricultural law, including routine tenancy arrangements as well as finding solutions to ensure that possession of agricultural land can be obtained from tenants to allow unhindered development or use;
  • Advice on ensuring that estates comply with health and safety requirements, proper licensing and the increasing obligations in terms of energy efficiency, sustainability and the commitment to reduce carbon, throughout the transition stages and beyond.
  • Procurement and installation of on site energy plant and advising on the most effective means of structuring heat and power supply arrangements for your portfolio.
