Eversheds Sutherland's approach to advising in this field is to understand the business context and what the organisation wants to achieve. We then work with the employer to map out a practical way forward which takes proper account of the law.
Employment tribunals
Eversheds Sutherland handle more than 1,000 tribunal cases each year. Latest figures show that we settle 90 per cent of claims without going to tribunal and only 2 per cent of the claims we deal with result in a loss for our client if they do go to tribunal.
We concentrate on eliminating uncertainty and developing with our clients a clear and efficient case strategy at the outset of every case to provide a service tailored to meet each client's needs and preferences. Feedback from clients shows that we met or exceeded their expectations in 98% of cases.
Compromise agreements
Too many lawyers and managers approach compromise agreements on a ‘one size fits all basis'. Eversheds Sutherland will not fill the compromise agreement in a routine case with unnecessary clauses that lead to pointless debates with other lawyers. By way of contrast, our role in negotiating the terms of a compromise agreement with somebody senior includes identifying how best to approach the negotiation by establishing:
- the basis for the initial discussion, eg performance, conduct;
- the best position with the individual concerned;
- what can be offered which is of low cost to the business but high value to the individual which can save thousands of pounds in the negotiation; and
- how to avoid the business being destabilised whilst the exit is completed.
Senior executive severance
Few solicitors in the UK have the relevant experience and expertise to provide support to companies faced with this challenge. Eversheds Sutherland has a number of senior lawyers who can provide support and have done so for a number of major FTSE 100 and FTSE 250 companies. We also have extensive experience in dealing with employment injunctions in the High Court, Court of Appeal and the House of Lords. Even more importantly, we are adept at achieving the outcome desired whether through negotiation with the other party's solicitors or through the courts.
