How we can help

MiFID Maps identify:

  • how the Level One MiFID I provisions map against the Level One MiFID II and MiFIR provisions;
  • each article of the Level One MiFID II Directive and MiFIR Regulation, by number and subject, as well as corresponding recitals which have an important role in giving meaning to some articles;
  • how the European Securities and Markets Authority (ESMA) have amplified the Level One provisions, through Level Two directives, regulatory technical standards (RTS) and implementing technical standards (ITS);
  • the provisions of the Organisational Regulation (Commission Delegated Regulation (EU) of 25.4.2016) which will replace sections of the FCA Handbook of Rules and Guidance; and
  • how the Financial Conduct Authority (FCA) is currently planning to implement the requirements of MiFID II in the United Kingdom (as it has indicated in Consultation Papers 16/19 and 15/43).

Why work with us?

Business orientated strategic thinking

We understand the need for our clients to take key strategic decisions in order to capitalise on new opportunities in a fast moving regulatory world. We have practical experience in advising clients on how to take advantage of opportunities in the new MiFID II frame work, taking account of the need to adopt a practical strategic approach that reflects our client’s business models.

"One stop" professional services solution

Rather than our clients having to instruct consultants and lawyers separately, Eversheds Sutherland Legal works with Consulting to provide a seamless service which enables us to assist clients as one coordinated team, which avoids any risks of double costs and potential conflicts of opinion as a result of instructing both a law firm and a consulting practice separately. We are also able to provide our legal and consulting services separately, should this be preferred.

A tailored service

We are aware that different clients have different approaches to MiFID II implementation, and tailor our services to account for specific needs, whether this be helping plan and manage an entire MiFID II implementation project or working on particular aspects in a supporting or validating role.

In depth experience

We are one of the firms which have been involved in lobbying over the MiFID II proposals, feeding into the FCA’s consultation process. As a result of helping to shape regulators’ thinking on MiFID II, we understand the underlying policy considerations and risk concerns underlying the MiFID II framework. This means that we are ideally placed to help clients understand the requirements of MiFID II as well as the regulatory attitude underlying the regulatory framework.

An understanding of the broader regulatory picture

We recognise that MiFID II is not a standalone regime, but rather is an important piece in the complex integrated web of rules and requirements which firms now have to navigate. We consider MiFID II in light of its interaction with other regulatory regimes, including for example AIFMD, the UCITS Directive, EMIR, PRIIPS and MAD/MAR, as well as utilising experience in areas such as data protection, employment and tax to help inform our advice. The result is that we deliver appropriate and measured holistic solutions that take account of the legal and regulatory landscape as a whole.
