Tim is a Partner in our Litigation and Dispute Management group with a commercial disputes practice and particular experience in corporate disputes and civil fraud claims. 

He is ranked as a "key lawyer" in Legal 500.

Tim helps clients to understand and manage legal risks and identify solutions for complex disputes.  Sometimes that requires the robust pursuit or defense of a dispute through High Court litigation or arbitration, but Tim also utilizes alternative dispute resolution mechanisms to explore opportunities for a negotiated outcome, without resorting to such formal processes.

He deals with commercial contract and tort claims and works closely with Eversheds Sutherland’s transactional M&A team to help clients manage disputes risks in major corporate transactions and maximize value from their investments. Tim regularly acts on post-transactions disputes, including completion account and earn-out disputes, restrictive covenant claims, and warranty and indemnity claims.

Tim also has particular experience acting on civil fraud claims (including following cyber incidents). He is currently acting in one of the largest fraud claims in the Commercial Court.

He always looks to utilize technology to assist in the efficient management of disputes, including by using artificial intelligence solutions in disclosure exercises, and using technology for effective legal project management.

Tim is now based in London, but has spent significant time in Hong Kong and Singapore and brings that international experience to his work — much of which includes a cross-border focus.

Commercial contract disputes

  • acting for key supplier to the UK defense industry in relation to the quality of goods and services provided in the context of a complex private finance initiative arrangement — disputes to be resolved by LCIA arbitration
  • acting for a US technology business on the termination of its distribution arrangements covering Asia, and the subsequent Court proceedings and ICC arbitration to deal with historic liabilities between the parties
  • acting for a private healthcare provider in dispute with the NHS regarding its trading arrangements, including the ability of the NHS to audit services provided by our client
  • acting for a private healthcare provider in dispute with an FM service provider, including disputes as to the quality of services provided and actions to unwind the parties’ commercial relationship

Corporate disputes

  • acting for the sellers of a large businss in the fast-moving consumer goods sector in relation to restrictive covenant claims, warranty & indemnity claims and an earn-out dispute
  • advising a clean energy fund on an earn-out dispute following its acquisition of a battery storage project
  • acting for a Chinese state-owned enterprise in a substantial completion accounts dispute with the seller of a Brazilian wind energy project
  • acting for the shareholder of a global hospitality business in a dispute under an English law shareholders agreement — this matter involved proceedings in the Indian Courts and advising the client on a potential SIAC arbitration in Singapore
  • acting for a US chemicals business in a US$100m dispute with a Japanese joint venture partner relating to a renewable energy manufacturing facility in Shenzhen, China —the claim was resolved through a HKIAC arbitration
  • acting for the buyer of a substantial European business in warranty claims against the seller arising from historic breaches by the target of local anti-trust and bribery laws — this matter was resolved prior to the commencement of an LCIA arbitration
  • acting for the buyer of a major UK power station in £120 million warranty claims in the English High Court arising from the state of maintenance of the power station at the time of acquisition
  • acting for the seller of a large IT business in defending claims against it under the warranties contained in the share purchase agreement

Civil fraud

  • acting for a high-net-worth individual defending claims of fraud valued at nearly US$1 billion — this includes acting for the client in Court of Appeal proceedings challenging jurisdiction
  • acting in English High Court proceedings in a claim for damages of US$87million in respect of a contract to buy an oil rig as part of a conspiracy led by a former managing director, his adviser and their associates ([2019] EWHC 472)
  • acting for a UK family office in High Court proceedings in a claim against the "arranger" for negligent and fraudulent misrepresentations following a failed investment
  • acting for a global securities business in a financial crime investigation involving legal issues in Guam, USA, Philippines, UK and Denmark
